Another Civic Si, another not-at-fault accident

The Borg and I got hit while driving at 55-60 mph on the interstate. Someone in a Toyota MR-S was zipping through traffic and made an abrupt lane change to pass me. He spun on the wet pavement, hitting my left rear door with his right front. This hooked me strongly to the left, turning me toward the concrete barrier on the left side of the road. I turned hard right to miss the barrier, and the car fishtailed, striking the barrier with the left rear. The front did not hit the barrier.

The left rear corner is killed. The entire left rear corner is about 4 inches narrower than it used to be. The bumper is pushed to the right, and the trunk is popped up. The lights and spoiler is gone. The left rear wheel hit the concrete barrier, and probably bent up some suspension parts. The left rear door has a big gap at the rear. The rocker panel and door have a damage from his wheel (I have a "donut," just like ol' Dale.) I have a hole in the left rear door from his bumper brace. The left side and left curtain airbags deployed, tearing the headliner and driver's seat in the process. The driver's seatbelt will not retract.

The MR-S hit the barrier almost head-on and was totaled. The cop told me that the driver of the Toyota told him that he "pulled out to pass me and lost it." I hope his insurance company pays up.

This came almost 8 months after a stop-sign runner killed my 2005 Si. Ugh!

problem is there is a third criteria besides fault and no fault, and that is the avoidable collision. if a driver collision is determined to have been avoidable, his/her rates would go up anyway. just pure speculation on my part...

I was driving in a straight line and hot hit in the door by a spinning car... he was sliding sideways and was still going faster than me, if that can tell you anything. I knew he pulled out to pass, but didn't know he was sliding until I felt him hit. I don't think I could have done anything to avoid him. I do not believe the driver was cited. I really don't care, as long as the insurance company pays up.

Seems like I'm seeing lots of posts like this lately. Hopefully it's just coincidence, not evidence of a new trend forming.

My brother in law was hit on I-95 a couple weeks ago in his relatively new truck. The other driver was an illegal alien with no license, and no insurance.

Do you have mandatory "uninsured motorist" insurance in your state (or your brother in law's state?). We do in maine. If that situation happens, you are covered even if you dont have comprehensive/collision by your own insurance company. You are required by law to show proof of uninsured motorist before registering.

Fetch-
Do you think they'll total your car? I'd guess so, given the damage.

Since he already had speeding tickets, he's fixing it himself. He's scared if he files a claim his rates will go up.

FYI, I do not believe I have mandatory uninsured motorist coverage, but I had it on this car, since I am still paying on it. When I got hit in my 2005 Si (Quack the Blue Duck), it was by an uninsured motorist who fled the scene. I caught him a few blocks down the road.

I am not sure if they will total the car. The damage is not severe, but it is damaged in an expensive way... If the car is totaled, I will start shopping for another Si or perhaps a 2006-2007 Accord V6 6-speed manual.

I understand that. I operate the same way, even when I'm moderately sure that they can't jack my rate for something. It sounds like they couldn't possibly jack his rate for being hit by an unlicensed, uninsured, illegal alien, but just in case...
