My wife's dad died a while back.

Because she, her sister and brother did not act soon enough and he went deeply into dementia and was therefore not to be reasoned with....

Ultimately, the courts were used to put the estate into a conservancy so the assets of the estate could be used to take care of them.

Because he thought that a 'will' took care of everything and did not create a 'living trust' to handle things, the state and lawyers were paid around $25,000 to do what could have been handled for free.
